DP&F’s Real Property team provides comprehensive legal services in all areas of real estate purchase and sales, including construction and development, financing, investment, ownership, and leasing and operation. Our clients include vintners, growers, lenders, hoteliers, contractors, property managers, developers and investors – as well as individuals and families with small or large land holdings.

  •  DP&F has handled more winery sales and purchases than any other law firm in the state, as well as vineyard leases in fourteen California counties. The attorneys in our real property group collaborate closely with attorneys in other disciplines to deliver seamless and efficiently executed legal services to our clients. We represent clients in a wide variety of industries, including real estate developers, contractors, property owners and managers, and landlords and tenants in all significant real property product types, including office, commercial, industrial, fractional ownership, multi-family, and hospitality.

  • Review and assessment of title reports and recorded easements and agreements affecting hundreds of acres and multiple contiguous parcels of prime Napa Valley vineyard land.

    Lead counsel in negotiation and drafting of comprehensive easement agreements and water agreement affecting hundreds of acres and multiple contiguous parcels of prime Napa Valley vineyard land networked and connected by multiple vineyard avenues and serviced by a fully integrated water collection and delivery system.

    Review and assessment of title reports and exceptions to title, including matters disclosed in title insurance surveys (ALTA Land Surveys) to provide title summaries for due diligence review by clients.

    Successfully negotiated revisions to numerous preliminary title reports in various transactions based on review and analysis of exceptions to title listed by title companies, resulting in the removal of exceptions to coverage in the final policies of title insurance issued at close of escrow.

    Successfully negotiated title coverage for a real estate sale where two title companies had originally declined coverage on the ground that the seller did not hold clear title. Negotiation and agreement was based on review of chains of title and analysis of the legal effect of the descriptions contained in various deeds in the chains of title.

    Drafted and recorded multiple easement agreements between various individual property owners.

    Drafted and recorded easement agreement affecting over 19 different property owners and including comprehensive maintenance and improvement agreement.

    Drafted and recorded boundary agreements.
